Record Sealing in Illinois
Criminal Defense Attorney Serving Lake County
After a criminal conviction, we understand it can be difficult getting your life back to normal. Employers and lenders conducting background checks can view your criminal record and deny you employment or a loan based off their findings. Fortunately, our Lake County criminal defense attorney can help you get your records sealed.
When you have your records sealed in Illinois, your file still remains intact but the general public does not have access to the information within it. The only agencies who have access to your record are law enforcement agencies.
Am I Eligible to Have My Records Sealed?
Most misdemeanor convictions are sealable but with a few limited exceptions. If you were convicted of a misdemeanor or placed on supervision or probation, you are eligible to have your records sealed after a period of time—usually 2 to 5 years—depending on your case. In addition, certain felony convictions are eligible for sealing. When a judge rules whether or not to have your records sealed, they will take into account any other arrests or convictions on your record before making the final decision.
Expungement vs. Sealing
When you petition to get your records sealed, government agencies still maintain the file. Law enforcement is still able to access the information but the general public is unable to gain access to your file. When your record is expunged, they are destroyed and then returned to you. Any other remaining copies are also destroyed and you name is deleted from public record.
