What Constitutes a Felony Level DUI?
In the majority of cases, felony level DUI charges result from having three or more previous DUI convictions. However, felony level charges may also be filed if:

- The offender had a Blood Alcohol Content (BAC) far beyond the legal limit

How Many DUIs Is a Felony in Illinois?
A third DUI conviction is considered an aggravated DUI offense and is considered a class 2 felony. Wich carries the following:
A minimum sentence of 10 days in jail or 480 hours of community service.
If the defendant’s BAC is 0.16% or higher, there is a minimum 90-day jail sentence.
If there are aggravating circumstances present, there is a maximum of 7 to 14 years of imprisonment.
If there was a passenger under 16 years of age, then there is also another penalty for completing community service in a program that benefits children.
